These Terms of Service (“Terms”) govern your use of landairenergy.com (the “Site”) operated by LandAir Energy (“LandAir Energy”, “we”, “us”, or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Use of the Site

You may use the Site for lawful purposes related to learning about LandAir Energy’s commercial solar services, requesting consultations, and accessing publicly-available information. You agree not to:

• Use the Site for any unlawful purpose or in violation of applicable laws
• Attempt to gain unauthorized access to any portion of the Site, our servers, or related systems
• Interfere with the Site’s operation or security features
• Use automated tools (bots, scrapers, crawlers) to access the Site except as permitted by robots.txt
• Submit false or misleading information through our contact forms
• Use the Site in any way that could damage, disable, overburden, or impair our infrastructure

3. Intellectual Property

We strive to provide accurate and up-to-date information about commercial solar economics, NJ utility interconnection processes, federal and state incentive programs, and our services. However:

• Solar incentive programs change. Federal Investment Tax Credit rates, NJ Successor Solar Incentive (SuSI) credit rates, and other program details cited on this Site may be superseded by subsequent regulatory action.
• Project economics depend on your specific facility, utility, and tax position. Numbers presented on this Site are illustrative and do not constitute a guarantee for any specific project.
• Engineering specifications, code references, and utility interconnection processes change over time. Specific requirements for your project may differ from descriptions on this Site.

Any project proposal, feasibility study, or contract you receive from LandAir Energy supersedes general information on this Site for the specific project covered.

5. Consultations and Proposals

Information requests submitted through the Site do not constitute a contract for services. Engagement with LandAir Energy begins only upon execution of a written agreement signed by both parties.

Paid feasibility studies, design services, and construction services are governed by separate written agreements that contain specific terms, deliverables, pricing, and warranties.

6. No Warranty

The Site is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

7. Limitation of Liability

To the maximum extent permitted by law, LandAir Energy and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of the Site, whether based on contract, tort, strict liability, or any other legal theory.

This limitation does not apply to liability that cannot be excluded under applicable law.
